15-Day Notice and ET (2007 CPC "Graywater Emergency" and 2010 CPC)

As most of you are aware, the two 45-day public comment periods for the graywater regulations closed in mid-October.  The Department of Housing and Community Development (HCD) received numerous comments. We have completed our evaluation of all comments received and, as a result, we believe some modifications are necessary.  Our intent is to keep the changes to a minimum.  It is anticipated that the proposed revisions will be made public beginning November 25, 2009.

The rulemaking process allows us to make modifications that are substantially related to our original proposal provided the revisions are then vetted in a 15-day public comment period.  The time between the closing of the 15-day comment period and the time HCD must submit its final package to the California Building Standards Commission (CBSC) in order to make the January 2010 agenda is very short.

HCD: Notices of Proposed Action Re Graywater Systems (2007 and 2010  California Plumbing Code, Title 24, Part 5)

To: All Stakeholders and Interested Parties

Attached please find two Notices of Proposed Action recently filed by the California Building Standards Commission (CBSC) announcing the 45-day public written comment periods regarding changes made to the California Plumbing Code.

The first "Notice" refers to the 2009 triennial code adoption cycle and concerns the adoption by reference of the 2009 Uniform Plumbing Code with amendments into the 2010 California Plumbing Code, including "graywater" (Title 24, Part 5.)

(NOTE: Written comments will be accepted by the California Building Standards Commission from August 28, 2009, until 5:00 PM on October 12, 2009.

California Plumbing Code (Title 24, Part 5, Chapter 16A, Part I)

Re:  Chapter 16A Nonpotable Water Reuse Systems, Part I (Graywater)

Since our last stakeholder meeting, we have reviewed the comments received and made some modifications to the graywater proposal.  In addition, we have reviewed the proposed timeline of the graywater standards and have decided to include a modification to the current plumbing code.  Our original goal to include the graywater standards in the 2010 California Plumbing Code (2010 CPC) will continue as originally planned and become effective January 1, 2011.

However, we will also propose the graywater standards for adoption as an emergency modification to the 2007 California Plumbing Code (2007 CPC).  The 2007 CPC is the code that is currently in effect in California.  By proposing these standards on an emergency basis, they will become effective upon filing with the Secretary of State. We will submit the emergency package to the California Building Standards Commission (CBSC) on July 1, 2009.  The package will go before the CBSC as an action item on July 30, 2009, and if approved, will be filed with the Secretary of State on August 4, 2009. This revised schedule will establish an effective date almost 18 months sooner than the original, non-emergency timetable.

Re:  Cancellation of April 16th Meeting and Rescheduling of Focus Group Meeting No. 2 - Ch. 16 Nonpotable Water Reuse Systems [California Plumbing Code]

The second focus group meeting to discuss the revised text of "Chapter 16 Nonpotable Water Reuse Systems, Part I (Graywater) and Part II (Recycled Water)" has been rescheduled on April 27, 2009, from 9:30 a.m. to 3:30 p.m.*(may end sooner), at HCD headquarters in Sacramento (see attached "Notice" for details).  This is the follow-up to the meeting previously held on February 25th.

The "Notice" and "Agenda" are attached; however, please note that the "Draft" of the proposed Express Terms is currently being revised.  We will forward the latest version, as soon as it is available, for your review and comment.
