Re:  Chapter 16A Nonpotable Water Reuse Systems, Part I (Graywater)

Since our last stakeholder meeting, we have reviewed the comments received and made some modifications to the graywater proposal.  In addition, we have reviewed the proposed timeline of the graywater standards and have decided to include a modification to the current plumbing code.  Our original goal to include the graywater standards in the 2010 California Plumbing Code (2010 CPC) will continue as originally planned and become effective January 1, 2011.

However, we will also propose the graywater standards for adoption as an emergency modification to the 2007 California Plumbing Code (2007 CPC).  The 2007 CPC is the code that is currently in effect in California.  By proposing these standards on an emergency basis, they will become effective upon filing with the Secretary of State. We will submit the emergency package to the California Building Standards Commission (CBSC) on July 1, 2009.  The package will go before the CBSC as an action item on July 30, 2009, and if approved, will be filed with the Secretary of State on August 4, 2009. This revised schedule will establish an effective date almost 18 months sooner than the original, non-emergency timetable.

After the emergency package goes before the CBSC, HCD will complete the rulemaking process for both the 2007 CPC and the 2010 CPC. Because the two proposals for Chapter 16A will be almost identical, we will run concurrent 45 day comment periods for both.

Please find attached the "Express Terms (ET)" modified as a result of our last meeting, the "Initial Statement of Reasons (ISOR)", which is the rationale for our proposals and the "Finding of Emergency".
